Welcome to ZroopDrive & thanks for using our services.

Please read these terms & conditions before using our application or using our website.

These terms and conditions of use (‘’Terms of Use’’) of the ZroopDrive website and mobile app, are made between Zroop Drive Pvt. Ltd. (a company incorporated under the Companies Act, 2013 (India) having its corporate address as , Office no C-622, Siddhi Vinayak Tower-C, B/H DCP Office, S G highway, , Ahmedabad, Gujarat, 380051) & Yourselves/Customer/User of ZroopDrive. If you continue to browse the website and/or use the mobile application you are agreeing to comply with and be bound by the Terms of Use.

1. Definitions

“We’, “Our”, “Us” shall be interpreted as ZroopDrive.
“You”, yourself / yourselves, Customer, Hirer and “your” shall mean a User, who meets the eligibility criteria set out below;
“Driver" or "Drivers" means a driver you engage with through your use of our website/application.
“Account” shall mean the account created by the Customer on the Application for availing the Services provided by ZroopDrive.
“Service” or “Services” shall mean the service of providing Driver solutions via the Application/Website.
Website shall mean as “Company Website’.
“Application” shall mean the mobile application “ZroopDrive” updated by Zroop Drive Pvt. Ltd from time to time.
Cancellation fee shall mean a fee payable by Customer/You, towards cancellation of driver booking.
“Fare” shall mean such amount payable by you/User, which is reflected on the Application, as the fare payable towards the distance travelled and time taken. Fare may depend on several factors such as the availability of the Driver(s) on the platform at the time, city and may also reflect the fares that may have been stipulated by the respective Governments from time to time. It may include components to reflect any promotions carried out by ZroopDrive.
“Peak charge” shall mean additional charge applied in the situation where the demand is more than the available supply.
“Force Majeure” includes but is not limited to strikes, lockouts, labour disturbances, civil commotion, riots, war, acts of terrorism, major traffic disruption, action of any government or regulatory authority, fuel shortages, abnormal weather conditions at the location of services, abnormal business circumstances or any other cause beyond the reasonable control of the affected party which by exercise of reasonable diligence could not have been prevented or provided against.

2. Eligibility

Our services are available only to those individuals & entities are competent to enter into a contract under the Applicable Laws, thus Customer must be at least 18 years above to use our service. If you are not eligible, please immediately abandon any and all attempts to register with us. We rely entirely on the information you provide and will not be held responsible if you or anyone else using your account.
As a minor if you wish to avail the Services, such Services may be accessed by your legal guardian or parents who have registered as users on the Site.
If you reside in a jurisdiction that restricts the use of the Service because of age, or restricts the ability to enter into contracts such as this User Terms due to age, you must abide by such age limits.

3. Registration And Account

You understand and acknowledge that you can register on the site/app by entering the registration data.
You shall ensure that the registration data provided by you is accurate, valid, true, and complete and is updated from time to time. The company bear no liability for false, incomplete, old or incorrect registration data provided by you.
You are solely responsible for maintaining the confidentiality of Your Registration Data and will be liable for all activities and transactions that occur through Your Account, whether initiated by you or any third party. Your Account cannot be transferred, assigned or sold to a third party. We shall not be liable for any loss that you may incur as a result of someone else using your password or Account, either with or without your knowledge.
We reserve the right to suspend or terminate your account with immediate effect and for an indefinite period, if we have a reason to believe that the registration data or any other data provided by you is incorrect or false, or that the security of the account has been compromised in any way, or for any other reason.
It is your responsibility to check to ensure that you download the correct application for your device. We are not liable if you do not have a compatible mobile device or if you download the wrong version of the Application for Your mobile device. We reserve the right to terminate the Service and the use of the Application should you be using the Service or Application with an incompatible or unauthorized device.
We allow you to open only one Account in association with Registration Data provided by you. In case of any unauthorized use of Your Account please immediately reach Us at Company’s email address.
Any promotional discounts and offers accumulated can be revoked without prior notice in the event of suspicious account activity or mala fide intent of the User.
In case, you are unable to access your Account, or find any other queries on ZroopDrive and its services, please inform us at company’s email address .

4. Use of Services

ZroopDrive provides technology based services for booking Drivers in certain cities of India basis to you and you agree to avail the Services offered by third party Service Providers, or drivers. When you book a Driver, the GPS receiver, which should be installed on the mobile device (smart phone) on which you have downloaded the Application or the Website, shall detect your location and shall send your location information to the relevant Driver. ZroopDrive shall take your booking request & have the sole discretion to accept or reject such request.
If the ZroopDrive accepts the booking request, the app/website will notify you and provides the information regarding the Driver including its name, contact number etc. ZroopDrive make efforts to bring you in contact with the service provider in order to provide services subject to availability of the Service Provider in or around your location at the time of your booking request made to the ZroopDrive.
For the avoidance of doubt, it is clarified that the ZroopDrive itself does not provide the Transportation Services, i.e. not providing any kind of vehicle. ZroopDrive only acts as an intermediary between the Driver and you. The provision of the Services by the Driver to you is therefore subject to the agreement entered into between you and the Driver. ZroopDrive shall never be a party to such agreement. ZroopDrive disclaims any and all liability in respect of the Drivers including any claims of employment or any vicarious liability arising out of the Service or otherwise.

5. Representation & Warranties (User Behalf)

You ensure that the information you provide to the ZroopDrive is accurate and complete. ZroopDrive has full authority for alltime to verify the information that you have provided. You may only access the Service using the authorized means. ZroopDrive reserves the right to terminate the Service and the use of the Application/ Website should you use the Service or Application with an incompatible or unauthorized device.
You have the legal right and authority to own and operate the vehicle when engaging our Services and you confirm, represent and warrant that the said vehicle is in good operating condition and meets the industry safety standards and all applicable statutory requirements for a motor vehicle of its kind. User will solely responsible for the full functionality of vehicles.
User possess the legal right to designate the driver as your agent & delegate the actual authority to the driver to operate your vehicle & make decisions on your behalf for the purposes of providing Services offered through the ZroopDrive Platform.
In the event of accident, Customer is solely responsible for complying with applicable laws & requirements.
Except for Driver's personal criminal liability, Customer are solely responsible for any consequences arising from your use of the Service or Driver. In any event, ZroopDrive shall not be held responsible for this account.
The ZroopDrive or the driver has right to refuse the service if the user is found to be in intoxicated state, if the user is misusing or damaging any of the devices of the driver or if the user ask the driver to break any traffic/RTO/City Police/or government rules for any purposes, the driver has the right to refuse such request by the user.

You shall comply with all applicable laws relating to the matters contained herein and shall be solely responsible for any violation thereof.

6. Charges & Payment

You will make payment for the full services that provided to you. You understand & accept that the total Payment including the applicable taxes, shall be payable by user to ZroopDrive immediately upon completion of the services. Any difference arising at the end of the service shall be payable by user to ZroopDrive immediately upon completion of the Services. The trip charges shall be updated or amended from time to time and it is your responsibility to remain informed about the current charges.
The User shall pay the driver fare (as displayed in the ZroopDrive App) or as agreed to in the terms of use as listed on the Application / Website, parking charges, additional night surcharge (where applicable), one way trips, toll charges and any fee or levy presently payable or hereinafter imposed by the law or required to be paid for availing of the Services.
User will pay for all the avail services, either by way of cash or any available non-cash or digital payment modes like credit card/debit card/ wallet/UPI/pay later merchants or any new payment methods that ZroopDrive introduces from time to time.
In the event, where payment related issues arises, except when such issue is due to an error or fault in the Site or Application , User shall be required to pay by the way of cash or issues shall be resolved between user & payment processor Any payment mode is non- refundable. ZroopDrive shall not be liable for the same.
At the end of the trip, we will facilitate to you to receive a copy of invoice on your registered email account with the ZroopDrive.
The ZroopDrive offers the mode /option for payment of tips to the drivers. The amount to be paid as tips is not mandatory and is solely as per the wish of the user or the experience of the user post availing the services.
The amount of tip is directly payable by the User to the driver and the ZroopDrive is neither involved nor responsible for any such tips paid by the User to the driver. The amount paid as tip is not taxable and no receipt to that effect will be provided, also the same is non-refundable.
The user agrees and accepts that the use of the services provided by the ZroopDrive is at the sole risk of the user.

7. Cancellation Policy

The driver will wait no more than time period decided by ZroopDrive from the requested trip start time, before they start the trip timer.
User can cancel the booked driver at any time through the ZroopDrive app or website, but cancellation charges may apply if you cancel after your driver has already departed. The ZroopDrive will notify the cancellation fare on application whenever you cancel the trip. You agree and acknowledge that you may cancel the services at any point of time subject to “Cancellation fee”. You shall be notified cancellation fee in advance whenever you attempt to cancel the service request.
The notification shall be on the application or site. You understand and agree such cancellation fee as part of the Total Service Fare of the subsequent trip or pay such outstanding Cancellation Fee before availing the subsequent Service.
The ZroopDrive will provide the receipt of the cancellation fee, if any, payable by you.
The Cancellation Fee shall be payable by you immediately upon levy. However, ZroopDrive may, at its sole discretion, include such Cancellation Fee payable by you as part of the Total Service Fare payable from your subsequent trip.

8. Customer Relationship Management

All issues, suggestions, questions, feedback and opinions, while using our services can be communicated with us via several modes such as self-served app, or website or email.
After the completion of your trip, you are entitled to given for suitable rating for the service provided. You agree to be fair, accurate and non-disparaging while leaving the comment, feedbacks, and testimonials on or about the trips or the Services.
Reporting of any issue needs to be within days decided by ZroopDrive policy of the happening of the issue, failing to which, such issue will not be addressed.
ZroopDrive will respond your issues within decided working days of your reporting the same and try their best to resolve it at the earliest possible. It is hereby clarified that issues are resolved on severity basis.

9. Emergency Services to Customer

Customers and drivers are free to consult over the ZroopDrive support team at the support number listed on the website or mobile app, if they are experiencing an emergency while travelling, and a representative will be on hand to assist.
The ZroopDrive will not be liable for any deficiency of service, provided to you under this clause on a best efforts basis, and this clause does not, in any manner, restrain you from seeking any other form of assistance from any other party.

10. Emergency Services to Customer

The company shall not be liable for any failure to perform any obligations under this user terms. Neither party hereto shall be responsible for delays or failures in performance resulting from acts beyond its reasonable control and without its fault or negligence. Such excusable delays or failures may be caused by, among other things, strikes, lock-out, riots, rebellions, accidental explosions, floods, storms, acts of God and similar occurrences. If the performance is prevented, hindered or delayed by a Force Majeure Event and in such case our obligations under this User Terms shall be suspended for so long as the Force Majeure Event continues.

11. Indemnification

By accepting these terms and conditions and using the service, user shall defend, indemnify and hold ZroopDrive, its affiliates, their licensors, and each of its officers, directors, other users, employees, attorneys and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys' fees and costs) arising out of or in connection with : (a) your violation or breach of any term of these User Terms or any Applicable Law or regulation, whether or not referenced herein; (b) your violation of any rights of any third party, including the Driver or use or misuse of the Application or Service.

12. Liability

The information, recommendations or the service provided to you on or through the website/application and the ZroopDrive’s call centre are for general information purposes only and do not constitute advice. The ZroopDrive will keep the site and its content up to date but will not guarantee that the content of the website/application is free of errors, defects, malware and viruses or the site is correct and up to date.
The ZroopDrive may not be liable for missing train/flight/bus/events or delays etc. as the service is dependent on many factors and not in ZroopDrive’s control. You must book your driver after taking into account the check in time, traffic and weather conditions, political rallies, natural calamities, traffic barricades, car’s breakdown and other unexpected delays.
The ZroopDrive shall not be liable for any damages resulting from the use of or inability to use the website/application, including damages caused by malware, viruses, network issues or any incorrectness or incompleteness of the information on the Website/Application.
The ZroopDrive shall not be responsible for any miscommunication/information of status update and benefits. All this information will be sent to your mobile number or registered email address with the ZroopDrive.
The quality of the Services requested through the use of the Application is entirely the responsibility of the Driver who ultimately provides such transportation services to you. ZroopDrive under no circumstance accepts liability in connection with and/or arising from the Services provided by the Driver or any acts, actions, behaviour, conduct, and/or negligence on the part of the Driver.
Any offers are subject to ZroopDrive discretion and may be withdrawn at any time and without notice.
ZroopDrive does not represent or endorse the accuracy or reliability of any information, or advertisements (collectively, the "Content") contained on, distributed through, or linked, downloaded or accessed from or contained on the Website/Application, or the quality of any products, information or other materials displayed, or obtained by you as a result of an advertisement or any other information or offer in or in connection with the Service.

13. Intellectual Property Rights

The ZroopDrive is the sole owner of all the rights to the website/application and its content. The website/application embodies trade secrets and intellectual property rights protected under worldwide copyright and other laws. All title, ownership and intellectual property rights in the Website/Application and its content shall remain with the ZroopDrive.
All rights not otherwise claimed under this agreement or in the website/application, are hereby reserved. The information contained in this website/application is intended, solely to provide general information for the personal use of the reader.
You can access the website/application to use the features, facilities and services for your personal and internal requirements only.
All content on this Website/Application is the copyright of ZroopDrive except the third party content and link to third party website on our Website/Application
Systematic retrieval of ZroopDrive content to create or compile, directly or indirectly, a collection, compilation, database or directory (whether through robots, spiders, automatic devices or manual processes) without written permission from ZroopDrive is prohibited.
ZroopDrive reserves the right to terminate the account of a User upon any infringement of the rights of others in conjunction with use of the Service, or if we believes that User’s conduct is harmful to the interests of ZroopDrive’s , its affiliates, or other Users, or for any other reason in ZroopDrive’s sole discretion, with or without cause.

14. User Accounts, Offers and Promotions

The ZroopDrive has the right to collect the user data including name, contact information and other details to facilitate services or use of its platform to avail the services.
User account bearing contact details and email address are created and owned by the ZroopDrive. Any promotional discount and offers can be revoked without prior notice in the event of suspicious account activity or mala fide intent of the user.
In such circumstances where the system is unable to establish the unique identity of the user against the valid mobile number or e-mail ID, the account will be suspended, the ZroopDrive reserves the full discretion to suspend the user’s account in the above event and does not have the liability to share any account information whatsoever.

15. Links to third party sites

The ZroopDrive may provide the links of third party sites by application/sites; however the ZroopDrive does not have any control over such sites, i.e., content and resources provided by them.
The ZroopDrive may allow user’s access to content, products and services provided by the third party sites through hyperlinks. The users are cautioned to read terms and conditions of such third party sites before using in order to be aware of the terms and conditions of the use of such sites.
The users acknowledge that the ZroopDrive has no control over such third party sites, does not monitor such sites, and ZroopDrive shall not be responsible or liable to anyone for such third party site, or any content, product or service made available on such a site.

16. Violation of User terms & Termination

In the event , if user are found to be involved in activities like carrying illegally substances in the vehicles or misbehaving with the driver or distract the driver or act in violation of Applicable Law, then you shall be liable to pay a fine to us or we shall also have the right to terminate the trip.
ZroopDrive has right to deny access to particular users without prior notice in order to protect the interest of the company. We reserves the right to deny, create or limit different access to the website/application and its features with respect to the different users.
If user violated any of the terms of the use, ZroopDrive has reserve the right to terminate your account or your access to the application/website.
If you have furnished us with misleading or false information, pursuant to request by the law or any governmental agencies, in case of any unexpected issues or technical issues, in case of interference with use of our website/application.
In case of termination by you or us, your account will be disabled and you cannot grant the access of your account or any information or content contained in your account. You will not attempt to create another account for accessing of using the website/application without the written consent of ZroopDrive.

17. Miscellaneous

The information contained in the website/application is for general information purposes only.
Any reliance you place on such information is, therefore, strictly at your own risk.
The ZroopDrive also ensure that, we are not responsible for the website/application being unavailable due to technical issues as it is beyond our control.
The above mentioned terms and conditions between user and the ZroopDrive with reference to the access and use of the website/application and the services offered by the ZroopDrive.

18. Jurisdiction

The courts of Ahmedabad, India shall have the sole and exclusive jurisdiction in respect of any matters arising from the use of the Services offered by ZroopDrive or the Terms of Use or any arrangement between ZroopDrive and the User.
